1. Acceptance of Terms
By using homenaturesphere.com, requesting a quote, signing a proposal, or allowing our crews to begin work, you ("Client") agree to these Terms & Conditions, which form a binding agreement between you and Home Nature Sphere ("Company"), located at 102 Shoshone Trl, Edenton, North Carolina, 27932.
2. Services
Home Nature Sphere provides home renovation services including but not limited to interior design and decor, exterior and garden renovation, home security, fire safety, roofing, solar, window replacement, flooring, and bathroom remodeling. The specific scope of any project is defined exclusively by the written, signed proposal ("Agreement") for that project, which prevails over these general terms where they conflict.
3. Quotes & Pricing
- All quotes are fixed-price, itemized, and valid for 30 days from issue.
- Quotes depend on site conditions observed during the walkthrough; concealed conditions (hidden water damage, structural defects, unsafe wiring) discovered during work may require a written change order before proceeding.
- Any change to scope requested by the Client is performed only after a signed change order stating its cost and schedule impact.
4. Payment Terms
- A deposit of 30% is due upon signing to reserve materials and crew dates.
- Milestone payments follow the schedule in your Agreement; the final payment (typically 10%) is due upon your final walkthrough approval.
- Invoices are payable within 7 days. Late balances may accrue a service charge of 1.5% per month or the maximum permitted by North Carolina law, whichever is lower.
- Financed projects are additionally subject to the terms of the third-party lender.
5. Scheduling & On-Time Guarantee
Project start and completion dates are stated in your Agreement. Our On-Time Guarantee provides a $500 credit per week of delay caused solely by the Company, excluding delays caused by weather events, changes requested by the Client, concealed site conditions, supplier failures outside our reasonable control, or force majeure.
6. Client Responsibilities
- Provide safe, reasonable access to the work area (water, electricity, parking where feasible).
- Secure pets and clear personal belongings from work zones before crew arrival.
- Approve material selections and change orders promptly; extended approval delays shift the schedule accordingly.
7. Warranties
The Company provides a 5-year workmanship warranty from project completion, covering defects in our installation labor. Manufacturer warranties on materials (shingles, windows, panels, appliances, etc.) are registered in the Client's name and transferred directly. The warranty excludes normal wear and tear, Client or third-party modifications, misuse, and damage from events outside our control. The warranty is transferable once to a subsequent property owner.
8. Permits, Codes & Insurance
The Company obtains and pays for standard building permits required for the contracted scope and ensures work meets applicable building codes. The Company maintains general liability ($2,000,000) and workers' compensation coverage; certificates are furnished upon request.
9. Cancellation & Refunds
Consultations and quotes are free with no obligation. After signing, the Client may cancel in writing within 3 business days for a full refund of monies paid, provided work has not commenced. Cancellation after commencement entitles the Company to payment for work performed, materials ordered, and reasonable restocking/remobilization costs, with any unused balance refunded within 14 days.
10. Photography & Marketing
With your written consent (requested at project completion), we may photograph completed work for our portfolio and marketing. Consent is optional and never a condition of service. We never publish interior photos showing personal identifying details without approval.
11. Intellectual Property
Design concepts, 3D renderings, and plans prepared by the Company remain our intellectual property until final project payment, at which point the Client receives a perpetual license to use them for the subject property. Website content, branding, and marketing materials remain the Company's property.
12. Limitation of Liability
To the maximum extent permitted by law, the Company's total liability arising from any project is limited to the amount paid by the Client under that project's Agreement. The Company is not liable for indirect, incidental, or consequential damages. Nothing in these terms limits liability that cannot be limited by law.
13. Dispute Resolution & Governing Law
These terms are governed by the laws of the State of North Carolina. The parties agree to first attempt good-faith resolution for 30 days; unresolved disputes shall be mediated in Edenton, Chowan County, North Carolina, and, if mediation fails, resolved in the courts of competent jurisdiction there.
